6/7/06

10 p.m.

I was on my way back to China Wok from making my deliverings, and I was in the right lane on Crater Road, heading towards the traffic light, which was green. There was a vehicle on the other side, who attempted to turn in front of me onto Graham Road (her light was a "yield on green"; however, I was too close to the traffic light and ended up colliding with the vehicle. The driver's back passenger side was dented, while the right side of my hood was destroyed.

Before I got out of the car, I used the cell phone and told my boss that I was in an accident, and I also called my mom to let her know where I was. Fortunately, both me and the driver were unharmed. I approached her vehicle, which was on the side of Graham Road, and asked her if she was okay, and she said yes. She asked me the same thing, and I also said yes. Here's where the incident gets shaky: The female driver (she appeared to be in her late thirties, early fourties) said that she had a "green arrow" on her traffic light, meaning that my traffic light would have been red, and the collision would be deemed my fault. I said calmy to her that I had a green light clear as day, and she still stuck to her story. In truth, my light was green, and she attempted to turn on a yield green, which meant she was at fault, not me.

A couple of drivers came to us to make sure we were okay, and one of the nearby drivers called the police. My mom and aunt came a few minutes later, as did the police, and he asked that the driver and me give him our licenses, registrations and insurances (Lucky for me, I was able to get all of this stuff on Monday). We then proceeeded to tell the cop our sides of the story, with the female driver claiming she had a green arrow, and me explaining that it wasn't possible since I had a green light on my side. Unforunately for me, with the physical evidence put into the equation and no witnesses to come forth to share what happened, the cop put ME AT FAULT FOR NOT OBEYING A TRAFFIC SIGNAL. He issued me a summons, and ordered a court date immediately. I was pissed off.

He did say that since my driving record was clean, I would be eligible for driver's school, a one-day, 8 hour course, and the female driver could head home, with no consequences heading her way. The cop did say he would subponea her, but she did not have to appear on the necessary court date. With all that said, I felt like there was really nothing I could do, even though I was telling the god-honest truth. I didn't get home until midnight, and my boss told me that I could give him the money for my deliveries tomorrow. My car was tolled home, and I was pretty distraught for the rest of the night.

6/8/06

6 a.m.

My cousin wakes me up, and I receive a phone call from my dad. He said the cop who arrived at the incident told him that a witness came forth (this person was behind the driver I collided with), and from her testimony, the cop came to my house no more than 10 minutes later, and retracted his summons brought at me. The witness said that the driver I collided with had indeed tried to cross over me with a yielding green light, and not the green arrow she had described in her story last night. My driving record stays clean, I don't have to attend driver's school, my car is still a big wreck, and I still must attend the court date to explain what happened.

I made some calls to my insurance company and the driver's insurance company, and made a claim on the accidents. So, everything worked out, and I am feeling a lot better today, even if my car is messed up.

Thats good, drivers nowadays are getting even worse, and they will even try to lie to cover themselves up :shakefist . Goodluck on getting your car fixed!

There's still a bit of a problem. The driver's insurance agency called me so that she could record my side of the story, as she also did the driver. She's suspicious because she never heard of a case where the officer gives me summons and then takes it back. I also could not name the officer nor the witness who supported my claim. So far, with the help of my brother, I managed to find the name of the officer, along with his badge number. I was also told that the witness has so far been deemed anonymous, but he or she will be appearing in court to testify next month. Still, with only liability insurance, it's likely that I'll be able to get my car back on the road any time soon.

Today, a representative from the female driver's auto insurance came to my house in order to look at my vehicle's damage.

She basically said my vehicle was a total loss, meaning that the damage to my car was so great, that fixing it would cost more than the vehicle itself. She said I had two choices, which would be to accept the car as is, or to take it to the junk yard, and I'd get some miniscule fee for the vehicle. It really sucks, becuase being that my car is 13 years old, some of the parts that got damaged in my car have to be replaced and special ordered.

The representaive then said that she was going to the police department to get the official police report, which will be faxed to their office. I can't call the office until monday, though. But then, once they are able to get their research done and all, then they will decide whether or not they will pay for the damages made to my car.

What kind of car do you have? Special ordering can get some of your parts, but looking at junkyards is also a pretty good place to get some parts for older cars. My brother had to try both to get some parts for his car.

I was involved in a similar situation back in 1993. Raining and foggy going to school, I was sitting in the intersection waiting to make the left, the light turned yellow, I proceeded to make the turn to clear the intersection. Barreling through the fog was a Suburban. I hear the engine whine with acceleration as panic set in. WTF was my only thought at that time. She was trying to beat the yellow light. Lady claimed that I cut her off and that she didn't see me. How much more of a contradiction was that? She obviously had the a RED light by the time she made it to the intersection, yet the insurance companies said it was my fault. I made a left ACROSS her lane of traffic. Even with her side a red light... I was the younger of the two drivers and therefore was LESS experienced behind the wheel and of course my vehicle was totalled (passenger side door was sitting in my lap and the words GMC about 5 inches from my head) Yeah... totalled. And for that type of damage to have occured, she had to have been doing well over the speed limit for that area which was a school zone 15 Mph. It's sad when people think that just because you're young, you don't know whats going on.
