Backstory: My freind moved into my apt complex last weekend and used me as a referral, saving me $100 on this month's rent. His roommate (a female) decided to change the referral to one of her not so close friends that also lives in the complex. First of all, I told my friend to move into my complex. Then he asked around for a room mate. So in my mind I am the definitive referral.

Problem: The money went to the female's friend. I say she owes me $100 (and so does my friend). Am I wrong?

How did she change the name. Is that legal?

The lease is under both their names. My friend filled out all the paperwork and the next day his room mate went in to sign the lease and just changed the name on the referral.

Honestly legally there's nothing you can do. That really sucks, but unfortunately it's true.

I would suggest he watch out with his roommate though. I know I'd have a bit of a problem with a roommate that changed paperwork without asking me.

Oh and changing it is legal as long as it hasn't been finalized. Since she was just then signing it it most definitely wasn't finalized yet.

I would still fight it or bring it to the attention of the complex. Did your friend confront her as to why she did it? What did she say?

We both talked to the complex when I went to claim it and thats when we found out what happened. Then my friend confronted her and she tried to play it off like she didn't realize what the paperwork was for. I haven't confronted her yet myself. Heck I havn't even met her.

If she didn't realize what the paperwork was for (as she says) then she should have no problem talking with her roomate present to the complex together to get things straightened out.

The problem is the complex already gave the money to the person she wrote in. And she knew very well she did it. I am just so pissed at her that I feel she jipped me out of my money in a very dishonest way and I hold her personally responsible for my $100.

EDIT: What about first seeing if the complex can retract the money and straighten it out?

No on the complex doing more. The paperwork says a name, they gave the money to that name. And no small claims. I have no legal right to the money. Its just that it was such a dick move on her part that made me so upset.

But I think it is much more about the principle.

I do however think he was over it as his last post was from well over a month ago.
